§ 94-1 Definitions.

The words hereinafter defined shall have the meaning herein indicated for the purposes of Part 1 of this chapter:

KENNEL

Any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.

§ 94-2 Dogs to be licensed.

No person shall own, keep, harbor or have custody of any dog within Pemberton Township without first obtaining a license therefor, to be issued by the Registrar of Dogs upon application by the owner(s) and payment of due fees, and no person shall keep or harbor any dog within the Township except in compliance with the provisions of Part  1 of this chapter. Pursuant to § 94-32 of this Code, the maximum number of licenses which will be issued to any person, which shall be defined to include a family unit, and/or owner for the same residential premises shall be four, except as otherwise permitted by § 94-32.

§ 94-4 License and tag fees; exemptions.

A. A person(s) applying for a license shall pay an annual fee of $10.80 for each dog (for a maximum of four dogs per residential premises). In addition to the foregoing license fee, each person shall pay a New Jersey registration fee of $1; a New Jersey Pilot Clinic Fund fee of $0.20 and a New Jersey pet population control fee of $3 for nonspayed/neutered animals (no fee shall be required for spayed/neutered animals for said fund). Said license, registration tags and renewals therefor shall expire on the last day of January in each year.

§ 94-9 Licensing of kennel, pet shop, shelter or pound.

A. Any person who keeps or operates or proposes to establish a kennel, a pet shop, shelter or a pound shall apply to the Registrar of Dogs for a license entitling him to keep or operate such establishment.

B. The application shall describe the premises where the establishment is located or is proposed to be located and the purpose or purposes for which it is to be maintained, and shall be accompanied by the written approval of the Burlington County health authorities showing compliance with the local and state rules and regulations governing location of and sanitation at such establishment.

C. All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained, and all such licenses shall expire on the last day of January of each year and be subject to revocation by the municipality on recommendations of the State Department of Health or the local County Health Department for failure to comply with all rules and regulations and after the owner has been afforded a hearing by either the State Department of Health or the County Department of Health.

D. All holders of such license shall not be required to secure individual licenses for dogs owned by such licensees and kept at such establishments; such licenses shall not be transferable to another owner or different premises. (N.J.S.A. 4:19-15.8)

§ 94-10 License fee for kennel, pet shop, shelter or pound.

The annual license fee for a kennel providing accommodations for 10 or less dogs shall be $10, and for more than 10 dogs, $25. The annual license fee for a pet shop shall be $10. No fee shall be charged for a shelter or pound. (N.J.S.A. 4:19-15.9)

§ 94-11 Dogs off premises of kennels, pet shops, shelters or pounds.

No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises except on leash or in a crate or other safe control. (N.J.S.A. 4:19-15.10)
