9-1 – DEFINITIONS.

As used in this Chapter:

Kennel means any establishment wherein the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.

9-2 – LICENSING PROVISIONS.

9-2.1 License; When Required. 

Licenses shall be required for the following dogs of licensing age:

a. Any dog owned or kept within the Borough by a resident of the Borough on January 1 of any calendar year.

b. Any dog acquired by any person during the course of any calendar year and kept within the Borough for more than ten (10) days after acquisition.

c. Any dog attaining licensing age during the course of the calendar year.

d. Any licensed dog brought into the Borough by any person and kept within the Borough for more than two (2) days.

e. Any dog licensed by another State, brought into the Borough by any person and kept within the Borough for more than ten (10) days.

9-2.5 Fees.

a. The person applying for a license shall pay a fee of fifteen ($15.00) dollars for each dog. He or she shall also pay one ($1.00) dollar for the registration tag for each dog. The same fees shall be charged for the annual renewal of a license and registration tag. Any person who shall fail to obtain a license within the time required by subsection 9-2.3 of this section, will be subject to, in addition to the license and registration fee, a delinquent fee of ten ($10.00) dollars for each delinquency.

b. In addition to the annual dog license fee, the person applying for a license shall pay a fee of twenty ($.20) cents for the State “Pilot Clinic Fund” and this amount shall be remitted to the Community Health Services, Department of Health, State of New Jersey. For all dogs that are licensed and are of a reproductive age which have not had their reproductive capacity permanently altered through sterilization, the person applying for the license shall pay an additional sum of three ($3.00) dollars and this amount shall be designated for the “Animal Population Control Fund” and remitted to the Community Health Services, Department of Health, State of New Jersey.

9-3 – PET SHOPS, KENNELS, SHELTERS, POUNDS.

9-3.1 License Required. 

Any person who keeps or operates, or proposes to establish a kennel, pet shop, shelter or pound shall apply to the Clerk for a license entitling him to keep or operate such establishment. Any person holding such license shall not be required to secure individual licenses for dogs owned by him and kept at his establishment. These licenses shall not be transferable to another owner or to different premises.

9-3.2 Application Information. 

An application shall contain the following information:

a. The name and permanent and local address of the applicant.

b. The street address where the establishment is located, or is proposed to be located, together with a general description of the premises.

c. The purposes for which the establishment is to be maintained.

d. The maximum number of dogs to be accommodated at any one time.

9-3.3 Approval of Health Officer. 

No license shall be issued until the proposed licensee submits a written statement from the Health Officer that the establishment or proposed establishment satisfactorily complies with all applicable local and State laws, regulations and ordinances governing the location of and sanitation at such establishment.

9-3.4 License Term. 

A license issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained and pursuant to N.J.S.A. 4:19-15.8, shall be issued annually and shall expire on the last day of June of each year.

9-3.5 License Fees. 

The annual license fees for kennel and pet shop licenses shall be as follows:

a. Kennel accommodating ten (10) or less dogs, ten ($10.00) dollars.

b. Kennel accommodating more than ten (10) dogs, twenty-five ($25.00) dollars.

9-3.6 Compliance with State Regulations. 

A license issued for a kennel, pet shop, shelter or pound shall be subject to revocation by the Council on recommendation of the State Department of Health or the Board of Health of the Borough for failure to comply with the rules and regulations of the State Department of Health or the Borough Board of Health, after the owner has been afforded a hearing by either the State Department of Health or the Borough Board of Health.

Any person holding a license to establish, keep or operate a kennel, pet shop, shelter or pound shall comply with all Borough ordinances and the rules and regulations promulgated by the State Department of Health governing the sanitary conduct and operation of kennels, pet shops, shelters and pounds; the preservation of sanitation therein; and the prevention of the spread of rabies and other diseases of dogs within and from such establishments.

9-3.7 Report to State Health Department. 

The Clerk shall forward to the State Department of Health a list of all kennels, pet shops, shelters and pounds within thirty (30) days after the licenses therefor are issued, which list shall include the names and addresses of the licensees and the kinds of licenses issued.

9-3.8 Control of Dogs off Premises. 

No dog kept in a kennel, pet shop, shelter or pound shall be permitted off such premises, except on leash, in a crate or under other safe control.
