§ 137-1 – Definitions.
As used in this article, the following terms shall have the meanings indicated:

KENNEL — Any establishment wherein the business of boarding, selling or breeding dogs is carried on, except a pet shop.
§ 137-2. – License required; compliance with regulations required.
No person shall own, keep or harbor any dog or cat within the Township without first obtaining a license therefor from the Department of Health and Social Services upon application and payment of the prescribed fee, and no person shall keep or harbor any cat or dog except in compliance with this article.
§ 137-9. – License required to operate certain establishments; exemption from individual license requirements.
A. Any person who keeps or operates or proposes to establish a kennel, a pet shop, a shelter or a pound shall apply to the Township Health Officer for a license entitling him to keep or operate such establishment. All licenses issued for such establishments shall state the purpose for which the establishment is maintained, shall expire on the last day of June of each year, and shall not be transferable to another owner or different premises.
B. Any person holding such license shall not be required to secure individual licenses for dogs and cats owned by such licensee and kept at such establishments.
§ 137-10. – Application for license to operate establishment.
The application shall describe the premises where the establishment for a kennel, pet shop, shelter or pound is located or is proposed to be located and the purpose or purposes for which it is to be maintained and shall be accompanied by the written approval of the Township Health Officer showing compliance with the local and state rules and regulations governing the location of and sanitation at such establishments.
§ 137-11. – Fees for license to operate establishment.
A. The annual license fee for a kennel providing accommodations for dogs shall be as set forth in Chapter 240, Fees. The annual license fee for a pet shop shall be as set forth in Chapter 240, Fees. No fee shall be charged for a shelter or pound.
B. License fees for such establishments shall be paid with the application.
§ 137-12. – List of licensed establishments to be forwarded to state authorities.
The Township Health Officer shall forward to the State Department of Health a list of all kennels, pet shops, shelters and pounds licensed, within 30 days after licenses therefor are issued, which list shall include the name and address of the licensee and the kind of license issued.
§ 137-13. – Animals off premises of establishments.
No dog or cat kept in a kennel, pet shop, shelter or pound shall be permitted off such premises, except on leash or in a crate or under other safe control.
§ 137-14. – Revocation of license to operate establishment.
All licenses issued for a kennel, pet shop, shelter or pound shall be subject to revocation by the Township Health Officer for failure to comply with the applicable provisions of this article or the rules and regulations of the State Department of Health, or of the Township Division of Health governing the same, after the licensee has been afforded a hearing by either the State Department of Health or the Township Division of Health.
§ 240-2 – Animals.
A. Pursuant to Chapter 137, Animals, Article I, Cats and Dogs, of the Code of the Township of Middletown, the following fees are hereby established:
(1) Annual dog licenses and each annual renewal:
(a) Altered dogs: $20.
(b) Nonneutered dogs: $25.
(2) Annual cat licenses and each annual renewal:
(a) Altered cat: $20.
(b) Nonneutered cat: $25.
(3)Annual kennel license.
(a) For a kennel providing accommodations for 10 or fewer dogs: $10.
(b) For a kennel providing accommodations for more than 10 dogs: $25.
