§ 157-3 License and registration tag required; placing tag on dog.

Any person who shall own, keep or harbor a dog of licensing age in the Borough shall, in the month of March, apply for and procure from the Borough a license and official metal registration tag for each such dog so owned, kept or harbored, which license shall be valid for a one- or three-year period. Each such dog shall have a collar or harness with the registration tag securely fastened thereto.

§ 157-7 Fees; expiration of license; guide dog exceptions.

A. The person applying for the license and registration tag may apply for a one-year license or a three-year license and shall pay to the Borough a fee as follows:

(1) For a one-year license, $14 for any dog of reproductive age which has not had its reproductive capacity permanently altered through sterilization, and $11 for all other dogs. A one-year license shall expire on the last day of March of the year following its issuance.

(2) For a three-year license, $42 for any dog of reproductive age which has not had its reproductive capacity permanently altered through sterilization, and $33 for all other dogs. A three-year license shall expire on the last day of March of the third year following its issuance.

B. Proof of sterilization shall be provided by a certificate executed by a doctor of veterinary medicine. In the absence of this certificate, it shall be assumed that the dog has not been sterilized and is of reproductive age.

§ 157-20 License required.

A. Any person who shall own, keep or harbor a cat of licensing age shall annually apply for and procure from the Borough a license and official registration tag with license number, or a registration sleeve, for each cat so owned, kept or harbored and shall place upon such cat a collar or other device with the license number securely fastened or displayed. Acceptable methods of displaying license numbers shall include, but are not limited to, breakaway or elastic collars. License tags or sleeves are not transferable. In lieu of the use of a collar or other device as aforementioned, the license number and other pertinent information shall be tattooed in the cat’s ear at the expense of the owner, keeper or harborer of such cat. Any cat not displaying a current license number shall be considered a stray cat and shall be subject to being taken into custody by the Borough or its agents and impounded at an animal shelter for disposition in accordance with the shelter’s policies and procedures.

B. Any person that shall fail to comply with the licensing provisions of this article shall, upon conviction, be subject to a $100 fine.

§ 157-22 License fee schedule.

A license shall be issued after the payment of the following fees:

A. For each neutered or spayed cat: $11.

B. For each unneutered or unspayed cat: $14.

§ 500-15 Definitions.

As used in this Code, the following terms shall have the meanings indicated:

KENNEL

Any establishment or premises wherein or whereon the business of keeping, raising, breeding or boarding dogs or other animals is carried on, except that this definition shall not include a pet shop.

§ 505-1 License required for kennel or pet shop.

No person shall operate a kennel or pet shop without having first obtained a license from the Board of Health. All such kennels or pet shops shall be operated in accordance with, and comply with, N.J.A.C. 8:23A-1.1 et seq., as same may be amended from time to time. Said regulations are hereby adopted by reference in their entirety, and will be enforced within the Borough by the Board of Health.

§ 505-2 Animals to be on premises.

No dog kept in a kennel, pet shop or pound shall be permitted off such premises, except on a leash or in a crate or other safe control.

§ 505-3 Conformity with zoning and building regulations.

All kennels, pet shops or pounds shall conform to the regulations in force under Chapter 300, Land Use and Development, and the State Uniform Construction Code.

§ 505-4 Location.

No kennels, dog houses, dog pens or dog runs shall be within 25 feet of any property line.
