6.08.010 Definitions.

The words hereinafter defined shall have the meaning indicated for the purposes of this chapter as follows:

“Kennel” means any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.

6.08.020 – Licensing provisions.

A. License—When Required. Licenses shall be required for the following dogs of licensing age:

1. Any dog owned or kept within the township by a resident of the township on January 1st of any calendar year;

2. Any dog acquired by any person during the course of any calendar year and kept within the township for more than ten (10) days after acquisition;

3. Any dog attaining licensing age during the course of the calendar year;

4. Any unlicensed dog brought into the township by any person and kept within the township for more than ten (10) days;

5. Any dog licensed by another state brought into the township by any person and kept within the township for more than ninety (90) days. Any person who harbors or possesses any dog for a period of fifteen (15) days or more, for the purpose of this chapter, shall be the owner of the dog or dogs so harbored or possessed.

D. License Fee—Late Fee—Tags.

1. License Fee. Every person who owns, possesses, keeps or harbors any dog or dogs within the limits of the township shall obtain a license for each dog and each dog shall be registered and numbered with the person and/or persons designated by the township committee for such purpose. Such person shall pay the sum of ten dollars ($10.00) as a license fee for each and every dog, for a one-year license period, provided each dog and every dog is spayed or neutered and vaccinated for rabies. If the dog is not spayed or neutered, such person shall pay the sum of fifteen dollars ($15.00) as a license fee for each and every dog for a one-year license period. Such license fees specified herein are exclusive of additional charges for New Jersey registration fee, New Jersey pilot clinic fund, New Jersey pet population control and any other charges imposed by or on behalf of the State of New Jersey or any other agency or subdivision thereof.

6.08.030 – Pet shops, kennels, shelters and pounds.

A. License Required. Any person who keeps or operates or proposes to establish a kennel, a pet shop, a shelter or pound shall apply to the person designated by the township committee for such purposes, for a license entitling him or her to keep or operate such establishment. Any person holding such license shall not be required to secure individual licenses for dogs owned by the licensee and kept at such establishments; such licenses shall not be transferable to another owner or different premises.

B. Application Information. The application shall contain the following information:

1. A description of the premises where the establishment is located or is proposed to be located;

2. The purpose or purposes for which it is to be maintained.

C. Approval of Board of Health—Compliance with State Regulations. Each application shall be accompanied by the written approval of the board of health, showing compliance with the local and state rules and regulations governing location of and sanitation of such establishments. Licenses shall be subject to revocation by the township committee on recommendations of the State Board of Health or the local board of health for failure to comply with the rules and regulations of either the State Department or local board governing the same after the owner has been afforded a hearing by either the State Department or local board.

D. License Contents and Term. All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained. All such licenses shall expire on the last day of January of each year.

E. Fees. The annual license fee for kennels and pet shops shall be as follows:

1. Kennel accommodating ten (10) or less dogs, ten dollars ($10.00);

2. Kennel accommodating more than ten (10) dogs, twenty-five dollars ($25.00);
