Sec. 5-26. – License; tags; impoundment; redemption; humane destruction; reports.

Every person violating any subsection hereof shall be subject to the general penalty provision of this Code.

(a) Annual license. Every responsible party, keeping, harboring or permitting a dog to remain on his premises shall register and secure a license for such dog if over the age of six months. Dog licenses shall be issued by the city license officer or a representative upon payment of a license fee of $5.00 for each spayed or neutered female or male and $10.00 for each unsprayed or unneutered female or male. Application for a dog license shall be made by the responsible party on a printed form provided by the city for that purpose, upon which he shall state his name and address, and the name, breed, color and sex of each dog owned or kept by him. Before any dog license shall be issued the responsible party shall present to the licensing officer a certificate of vaccination from a licensed veterinary surgeon showing that such veterinary surgeon has vaccinated the dog sought to be licensed, with an antirabies vaccine effective to create immunization from rabies for at least the effective period of the license. The provisions of the article shall not apply to a dog whose responsible party is a nonresident temporarily within the city, nor to seeing-eye dogs which have been vaccinated, and are trained and actually used to assist a blind person. Licenses shall be valid for one year from the date of issuance therefore, renewal licenses shall be due on the anniversary date of issuance.

(d) Redemption and fees. The owner of a dog shall be entitled to resume possession of any impounded dog, before it is disposed of, upon compliance with the license provisions in section 5-18 and the payment of the impoundment fees set forth in this article. The city shall require that such dog be vaccinated with antirabies vaccine as a condition for the release of such dog. Any dog impounded under the provisions of this article may be reclaimed or adopted upon the payment by the owner to the city of $10.00 and the additional sum of $4.00 for each day or fraction thereof such dog is kept at the expiration of the ten-day detention period, except that unspayed females and unneutered males may be adopted only upon deposit of $20.00 to guarantee the animal will be spayed or neutered within 30 days of adoption or after the animal has attained six months of age.

(e) Humane destruction of impounded dogs. Any dog impounded under the provisions of this article and not reclaimed by the owner within ten days may be humanely destroyed by a veterinarian or a qualified person designated by the city manager by injection of sodium pentobarbital, or placed in the custody of some person deemed by the director of public safety to be a responsible and suitable owner who will comply with the provisions of this article and pay the impoundment fees and if such dog is an unspayed female, will agree to have such female spayed. Diseased or dying dogs may be humanely destroyed at the time of collection except that if the owner can be discovered from the tags on the animal he will be notified prior to disposing of the animal.

Sec. 5-29. – Roaming on neighbor’s property.

(e) Impounded cats, both male and female, shall be available for adoption to members of the general public, when deemed appropriate by the animal control officer, for an adoption fee of $5.00 plus $4.00 for each day the cat had been impounded along with a $20.00 spay or neuter fee guaranteeing the cat will be spayed or neutered within 30 days from the date of adoption or within 30 days of the animal attaining six months of age.
