Sec. 14-70. – Spaying and neutering required.

(a) It shall be unlawful to own, possess, control, or keep in the City of Moultrie any dog or cat over the age of six months that has not been spayed or neutered except for the following:

(1) Any dog or cat kept for the purposes of commercial breeding by a person holding a valid and current breeder’s license issued by the Georgia Department of Agriculture, Animal Protection System, provided that the holder of the license provides a copy to the City of Moultrie on annual basis within 30 days of the issuance and/or renewal of such license.

(2) Any dog or cat for which a Georgia licensed veterinarian has executed and signed a document expressing a medical opinion that the dog or cat is unfit to undergo the required procedures for spaying or neutering for health reasons shall be exempt from spay and neuter requirement during the duration of the relevant health condition only.

(3) Any dog or cat which is in the City of Moultrie to participate in a show or event wherein such dog or cat is entered, competing, or actively participating shall be exempt from Spay and Neuter requirement only during the duration of show or event, including traveling to or from such show of event.

(b) Any and all costs associated with spaying or neutering shall be the responsibility of the owner of the dog or cat.

(c) Any unaltered dog or cat may be impounded by any duly authorized animal control officer, law enforcement officer, or authorized firefighter and shall not be released to the owner thereof unless and until the owner satisfies the fine imposed and agrees in writing to have the animal spayed or neutered.

(d) Violations of this chapter shall be punished on an escalating schedule as follows:

(1) First Offense:$25.00
(2) Subsequent offenses:$25.00 plus and additional $25.00 for each offense after the First Offense (i.e.. a Fourth offense would be $25.00 as for a First Offense plush $25.00 for the Second Offense plus $25.00 for the Third Offense plus $25.00 for the Fourth Offense for a total of $100.00).

Violations shall not be dog or cat specific, but shall be based upon the number of violations charged against the owner, possessor, controller, or keeper of any cat or dog.

(e) The fine amounts and cost of spaying and neutering set forth in this section shall be in addition to any fees, costs, charges, and the like imposed by the impounding facility.

(f) Whether a dog or cat shall have attained the age of at least six months shall be determined by the Director of the Colquitt County Humane Society, by any duly authorized animal control officer, by any licensed veterinarian of the State of Georgia, or by any reliable veterinary records of such dog or cat.
