DIVISION 2. – IMPOUNDMENT

Sec. 18-91. – Generally.

(d) No at large unaltered dog or cat impounded more than twice in an eighteen-month period may be redeemed by any person until the animal is spayed or neutered. The sterilization shall be accomplished by transporting the animal, by animal control personnel, to any duly-licensed veterinarian in Jefferson County. In all cases, the animal’s owner shall not hold liable the City of Monticello or the city council members, individually or in their official capacity, and all members of the animal control authority, individually and in their official capacity, and all of the city’s employees, appointees, contractors, subcontractors, and agents from any and all liability, for any and all claims, causes of action, demands or damages, and costs (to include reasonable attorney fees) present, past and future, contingent or otherwise, arising from the spay or neuter of such dog or cat. The owner is responsible to pay the veterinarian fees prior to redemption.

Sec. 18-92. – Adoption of impounded animals.

At the discretion of the animal control authority, unclaimed impounded dogs and cats may be released for adoption as a pet to members of the public. No dog or cat shall be released for adoption as a pet without being neutered, microchipped, and vaccinated against rabies. Rabies vaccination fees, neutering fees, microchip implant fees and veterinary costs may be assessed, as well as an adoption fee, to be determined by city council resolution.
