Sec. 6-2. – Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Dog/canine breeder means any person, business, organization, or corporation that does not meet the state (MDARD) requirements for the large-scale breeder and has fewer than 15 intact animals over the age of four months, and that breeds animals for sale or trade.

Sec. 6-25. – Dog/canine breeder registration.

(a) Registration. Dog/canine breeders as defined in section 6-2 are required to be registered with Macomb County Animal Control. Registrations are limited to one per person, entity, corporation, and location annually. The applicant must not have been convicted or found responsible of animal negligence, cruelty, abuse, or any violation of the City of St. Clair Shores Animal ordinances or Macomb County Animal Control Best Practices. All registration requests are subject to approval. Registration fees shall be established by Macomb County Executive or its designee.

(b) Inspection. The registrant shall allow an inspection performed by animal control as specified “Animal Control Best Practices in Macomb County, Michigan”, without a warrant, of the premises used for sheltering, harboring, and/or maintaining, except for those portions of the premises used solely for human habitation or to house personal pets not used for breeding. Conditions are specified in St. Clair Shores Animal Ordinance section 6-14, animal care. Dog/canine breeders shall maintain current verifiable records for a period of at least two years. The records shall include:

(1) The verified name and address of the person from whom the animal was acquired, where the animal was acquired, and the date that the animal was acquired.

(2) A description and identification of the animal, including the animal’s identification information, color, breed, sex, alteration status, and approximate weight and age.

(3) The date and method of disposition of the animal. If the animal is adopted, transferred, or sold, the records shall also include the verified name and address of the person to whom the dog is adopted, transferred, or sold.

(4) The number of intact breeding adult animals housed by the registrant each calendar month.

(5) Breeding records for each female intact animal that include the approximate date the animal was bred and the birth date and size of each litter.

(c) Age limit. A county registered dog/canine breeder may not breed any dog/canine over the age of 12 years at the time of mating.

(d) Breeding limit. Each female intact animal shall have no more than six litters in her lifetime.

(e) Medical care. Every dog/canine breeder registrant shall have a primary veterinarian responsible for the veterinary care of the animals. All animals on the premises must be current on required rabies, species/age specific vaccinations and be licensed. Pet health certificates are required and must be issued by a veterinarian; a copy must be provided to the new owner when selling, trading, exchanging or otherwise placing the animal, and a copy must be kept for the breeder’s records and provided during inspections. Animals involved in interstate transport will be required to have a valid certificate of veterinary inspection.

(f) Limitation on the number of dogs per section 6-4. Limitation on number of dogs applies for any dogs over four months of age.

(g) [Authority.] The animal ordinance committee shall have the authority to impose reasonable conditions upon unintended dog/canine pregnancies provided such conditions are designed to encourage compliance with this chapter.
