Sec. 10-1. – Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Nuisance dog means a dog that may reasonably be assumed to pose a threat to public safety as demonstrated by any of the following behaviors:
(1) Without provocation, chasing or menacing a person or domestic animal in an aggressive manner;
(2) Running at large or being impounded no less than two (2) times within any twelve (12)-month period;
(3) Any other action that results in the owner being cited by Allegany County Animal Control Personnel two (2) or more times within any twelve (12)-month period;
(4) Acting in a highly aggressive manner within a fenced yard or enclosure and appearing to a reasonable person to be able to jump over the fence or escape from the enclosure; or
(5) Damaging the property of anyone other than its owner.
Sec. 10-5. – Nuisance dog determinations.
(a) Any dog may be determined to be a nuisance dog if it meets any of the behavioral criteria set forth in the definition of the term “nuisance dog” and such behaviors are documented in official reports of the Frostburg City Police Department, Allegany County Sheriff’s Department, Maryland State Police or any other law enforcement agency operating within the jurisdiction of the City.
Sec. 10-8. – Consequences of a nuisance dog determination.
(a) If the City Administrator determines that a dog is a nuisance dog under the provisions of this article, the owner shall be required to comply with the requirements set forth below:

(2) The dog shall be spayed or neutered, and the owner shall provide the City Administrator with documentary proof of said spaying or neutering no later than ninety (90) days from the date of the notice provided for in section 10-5(b).
