6.04.120 – Breeders and commercial operations.
A. No person shall operate a breeding, boarding or commercial animal establishment or keep more than four animals without first obtaining a permit. No fee shall be required of a veterinarian or animal shelter.
B. Applications for permits shall be on forms provided by the city. Failure to provide humane care to animals or failure to abide by city ordinances shall be grounds for revocation of the permit. The city council shall have the authority to revoke permits after the permit holder has been given a public hearing and if due cause for revocation is shown. Permits shall be for the time period January 15th through December 31st of each year. Permits may be applied for at any time but the fees shall not be prorated. Facilities shall be inspected by the animal control officer prior to granting a permit. Thereafter, the animal control officer may inspect the premises at any reasonable time.
C. The fee for each permit issued hereunder shall be one hundred fifty dollars ($150.00) per calendar year.
D. Failure to obtain a permit prior to operation of a breeding, boarding or commercial animal establishment, or the keeping of four or more animals, or failure of an existing operation to obtain a permit within thirty (30) days of the adoption of this section shall result in a fine of not less than three hundred dollars ($300.00) and not more than the fine set forth in Section 1.20.010(A). In addition, the city may close the operation until such permit is obtained.
