Sec. 4-64. – Pit bulls required to be spayed or neutered.
(a) It is unlawful for any person to own, keep, or harbor any dog within the city that the person in possession knew, or should have known, was a pit bull that has not been spayed or neutered.
(b) Exceptions to the requirement that a pit bull be spayed or neutered include the following:
(1) The pit bull is under eight weeks of age.
(2) The pit bull cannot be spayed or neutered without a high likelihood of suffering serious bodily harm or death due to a physical abnormality. A veterinarian must certify such a condition exists in the animal and the period of time after which the pit bull can be spayed or neutered.
(3) The pit bull has been present in the city for less than 30 days.
(4) The owner, keeper or harborer has obtained a license to keep an intact pit bull.
(c) License for keeping an intact pit bull:
(1) An owner, keeper or harborer of a pit bull which is either a show dog or a breeding dog may obtain a non-transferable intact pit bull license valid for a period of one year. The license may be obtained from the police department if all of the following conditions are met:
a. The applicant has provided a copy of the American Kennel Club (AKC) or United Kennel Club (UKC) registration, registration number, and pedigree documents for the dog.
b. If the intact pit bull will be used for breeding, the applicant must possess a city business license. If more than one owner, keeper or harborer is involved in the breeding process, each party must apply for and be granted a business license and an intact pit bull license. Sections 4-1 and 4-62 shall apply.
c. If the intact pit bull is a show dog, the owner, keeper or harborer must provide documentation that the animal has participated in at least one sanctioned dog show within the previous 365 days.
d. The application shall be accompanied by a license fee for the dog. The license fee shall be in accordance with section 4-2.
e. Upon approval of the application and the payment of the applicable fee, an intact pit bull tag shall be issued for the dog.
(2) The intact pit bull license must be renewed annually for so long as the owner, keeper or harborer continues to maintain the intact animal.
