Sec. 5-33. – Spay/neuter requirement.

(a) Within the city corporate limits, no person may own, keep, or be in possession of a cat that is six (6) months of age or older which has not been spayed or neutered, unless otherwise exempt from this requirement under this section.

(b) Within the city corporate limits, no person may own, keep, or be in possession of a dog that is classified under this chapter as a potentially dangerous animal that is six (6) months of age or older which has not been spayed or neutered, unless otherwise exempt from this requirement under this section.

(c) Whether a cat or dog has attained at least six (6) months of age will be determined by the city animal control officer, by any duly-authorized animal control officer, by any licensed veterinarian, by the Walker County Animal Shelter Director, or by reliable veterinary medical records concerning any such dog or cat.

(d) Any cat or dog kept for purposes of commercial breeding by a person holding a current breeder’s license issued by the Georgia Department of Agriculture, Animal Protection System, is exempt from this requirement.

(e) Any cat or dog for which a licensed veterinarian has signed a document expressing a medical opinion that the animal should not be spayed or neutered for health reasons is exempt from this requirement for the duration of the relevant health condition.

(f) Any citation issued for a first offense violation of this requirement will be dismissed by the recorder’s court if, prior to arraignment thereon, the defendant provides reliable veterinary medical records demonstrating that such dog or cat has been spayed or neutered.
