Tethering/Chaining

Sec. 4-45. – Running at large prohibited.
(a) Confinement of dogs on private premises. It shall be unlawful and punishable as a misdemeanor for any person owning, keeping, possessing, harboring or maintaining a dog to cause, permit or allow such dog to be at large on or about any place, lot or premises or portion of same within the city. All dogs within the city shall be kept:

(2) Restrained by means of a trolley system or a runner attached to a pulley on a cable run between the hours of 6:00 a.m. and 10:00 p.m. when the owner or other person this article applies is present on the premises, if the following conditions are met:
a. Such restraint shall be fixed in such a manner to allow the dog free use of the restraint without it becoming tangled, wrapped around an object or shortened to prevent injury or strangulation,
b. The restraint shall also be an appropriate weight for the dog and shall be fixed to a proper fitting harness or collar with swivel attachment that does not unreasonably pull on the dog unless the dog is attempting to do beyond the area of which the system is designed, and the harness or collar shall be made of a suitable material that will not cause damage to the dog’s skin and there shall be room between the collar and the dog so that two (2) human fingers may fit in between (the collars shall not be choke collars, pinch collars or prong collars),
c. Only one (1) dog shall be tethered to each cable run,
d. There shall be a swivel on both ends of the tether to minimize tangling the tether,
e. The cable run must be at least fifteen (15) feet in length and mounted at least four (4) feet and no more than seven (7) feet above ground level and shall give the dog enough room to have continuing access to food, water, and shelter, and at no point shall the dog be confined in an area that is not well drained or where it is forced to stand, sit, or lie in excrement,
f. The trolley or cable run must be an appropriate configuration to confine the dog on the property of the owner or other person to which this article applies, but it shall not be configured in a way that would allow the tether to extend over an object or edge that could result in injury or strangulation of the dog or to become entangled with other objects or animals,
g. No unsterilized female dogs shall be attached to a trolley or cable run nor shall a trolley or cable run be used when doing so would subject the dog to dangerous conditions, including attack by other animals and taunting, harassing, hitting, or threatening by persons,
h. The dog shall be at least six (6) months of age or older,
i. Dogs shall not be tethered during natural disasters such as floods, fires, tornadoes, blizzards, or other severe weather.

(c) No dogs shall be tethered, chained, or otherwise affixed to a stationary point except a dog may be tethered while actively participating in or attending an organized show, field trial, agility event, herding contest, or other similar exposition or event of limited duration, that involves the judging or evaluation of the animals, or when under the care and supervision of a licensed veterinarian.
