§ 91.001 DEFINITIONS.
ANIMAL DEALER. Any person engaging in the business of buying and/or selling any animal or animals, including fish, for the purpose of resale to pet shops, research facilities, another animal dealer or to another person, including the sale of any animal from any roadside stand, booth, flea market or other temporary site. ANIMAL DEALERS are also subject to the provisions of this chapter.

KENNEL or CATTERY. For purposes of this chapter, a place that does all or some of the following:

(2) Breeds more than two domestic animals for reproduction in a 12-month period.
§ 91.025 OTHER REQUIRED LICENSES AND PERMITS.
(B) License or permits in these categories shall be effective each July 1 and be valid for each event, yearly or 24 months, respectively, as indicated below. Each holder of a license or permit consents to an inspection by the Animal Control Officer during upon request during reasonable hours during the respective periods.
(1) Kennel. Twenty-four months.

(C) The application for or the grant of a license set forth under divisions (A) and (B), above, except for dogs licensed under divisions (B)(l4), and (B)(l5), is deemed to permit periodic inspections of the public areas of any such licensed entity during such entity’s business hours for the purpose of verifying compliance with the terms and conditions of this chapter. This section, and all other provisions in this chapter authorizing such inspections, shall be reasonably construed and applied by CAC personnel.
(D) Any person applying for a license under this chapter or elsewhere under this chapter who is not the owner of the property for which the license is sought must, in addition to all other requirements, provide a letter of authorization from the landlord or other property owner for the activity being licensed. This letter must have the name, address, and telephone number of the property owner.
(E) It shall be the responsibility of the applicant for a license to confirm that the activity for which the license is sought is allowable under the Town of Clarksville Zoning Code, and the issuance of a license does not permit and shall not be construed permitting activities prohibited under the Zoning Code.
§ 91.026 LICENSE AND PERMIT RENEWAL; REVOCATION; APPEALS.
(A) Renewal. All licenses and permits required under § 91.025 shall be renewed on or before July 1 of each year for those requiring annual or bi-annual renewals and 30 days prior for event dates.
(B) Revocation.
(1) The Director may revoke, suspend or deny any licensed issued or required hereunder.
(2) Grounds for such revocation, suspension or denial include, but are not limited to, conviction pursuant to any violation of this chapter or conviction pursuant to any state or federal law regarding animals.
(3) License revocation, suspensions, or denials shall be in writing and state the grounds therefor.
(C) Appeals.
(1) Any person who receives such license revocation, suspension or denial notice issued pursuant to this chapter may appeal such notice to the Town Manager within ten days following the receipt of such notice unless such period is extended by the Town Manager.
(2) Any appeal from such notice shall be in writing, shall state the grounds therefor and shall be signed by the person bringing the appeal or their authorized representative.
(3) Failure to file a timely appeal to a license revocation, suspension or denial notice shall result in license revocation, suspension or denial.
(4) If requested by the appellant, a hearing shall be held on the issues raised by the appeal.
(5) The hearing shall be held within a reasonable period of time before the Town Manager or his/her designee. The decision of the Town Manager shall be final for all purposes of this chapter.
§ 91.065 KENNELS OR CATTERIES.
(A) All kennels or catteries shall, in addition to the other requirements of this chapter, comply with the minimum standards of this section. Failure to meet these standards shall be grounds for denial or revocation of a license pursuant to §§ 91.025 through 91.030 and the issuance of a citation subjecting the owner to the penalties and fines provided in § 91.999.
(B) Each kennel or cattery shall comply with the following standards:
(1) Each dog or cat, four months of age or older, must have proof of a valid vaccination against rabies.
(2) Each kennel or cattery license shall apply to up to five dogs or cats and shall require an additional kennel or cattery license for each increment of up to five dogs or cats.
(C) Indoors: animals which are kept primarily indoors shall be provided with wholesome food and clean water, a clean-living environment free of accumulated waste and debris, comfortable temperature and ventilation, and provided veterinary care when needed. If allowed access to outdoors on a temporary basis, the outdoor area shall be kept free of waste and debris and well-drained. Such outdoor area shall comply with all restraint requirements contained in this chapter.
(D) Outdoors: animals which are kept primarily outdoors shall be provided with proper shelter, a clean-living environment free of accumulated waste and debris, supplemental protection from weather extremes, and well-drained. Such outdoor area shall comply with all restraint requirements contained in this chapter.
§ 91.105 NUMBER OF DOGS ON RESIDENTIALLY USED PROPERTY.
(B) It shall be unlawful for any person to breed more than two domestic animals for reproduction in a 12-month period without obtaining a kennel license from the Planning and Zoning Department.
