Sec. 5-39. – Breeder/hobbyist permit.
(a) All professional or hobbyist breeders shall obtain a permit from the village.
(b) Any person desirous of obtaining a breeder permit shall make application on forms provided by the village. No breeder permit shall be issued to any multiple-family residential premises and only one permit shall be issued to any one household. Upon verification of the information provided, receipt of required certifications and state license, satisfactory inspection of related premises and facilities by the animal control officer, or other person designated by the village manager to perform such inspections, and payment of the fee involved, a breeder permit shall be issued.
(c) A fee in the amount established by the annual fee ordinance shall be paid for a permit. Permits expire at the end of the calendar year for which they were issued.
(d) Falsification of original application data or failure by the breeder to properly amend original application data as required during the licensing year shall be cause for revocation of the permit. Further, a nuisance judgment against the holder of a breeder permit may serve as a reason for permit revocation. Three nuisance judgments against the holder of a breeder permit within any twelve-month period shall result in automatic revocation of the permit. Once revoked, a permit shall not again be issued in subsequent years.
(e) The maximum number of dogs or cats or any combination thereof, over six months of age, shall not exceed a total of ten animals on any one single-family residential property by a professional breeder/hobbyist.
