13.02 – Definitions.

“Kennel” means any establishment or premises, where four or more dogs or four or more cats or any combination thereof over four months of age are boarded or kept for any purpose whatsoever, or on which more than two such animals are raised for compensation or kept for sale, with the exception of regularly established veterinary hospitals, pet shops, pounds or shelters.

“Kept” means owned, harbored, raised, cared for or possessed, whether temporarily or long-term.

13.12 – Business licenses required.

(a) License. Any person who keeps or maintains any kennel, pet shop, shelter, pound, animal hospital, carnival animal exhibit, circus, petting zoo or animal ride within the City shall obtain a license or permit for the conduct of such business in accordance with applicable City Ordinances.

(b) Location. Kennels, pet shops, shelters, pounds, animal hospitals, carnival animal exhibits, circuses, petting zoos or other animal rides shall be permitted only in areas where such use is permitted by the Elmhurst Zoning Ordinance.

(c) Sanitary Conditions. It shall be unlawful to keep, use or maintain any kennel, pet shop, shelter, pound, animal hospital, carnival animal exhibit, circus or petting zoo that is unsanitary, foul or offensive or in any way detrimental to the public health or safety or that violates state or local sanitation requirements.

(d) Inspections. Any premises where animals are kept shall be subject to such inspection by authorized persons as may be necessary to insure compliance with the provisions of this Section or any other provision of this Chapter. Subject to compliance with legal requirements, such authorized persons shall have the power to make or cause to be made entry into any building or premises in which is contained a kennel, pet shop, shelter, pound, animal hospital, carnival animal exhibit, circus or petting zoo for the purpose of making such inspections.
