ARTICLE 10-2-8. – PET SHOPS
Sec. 10-2-8.1. – Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Pet shop operator means any person who sells, offers for sale or exchange, or offers for adoption, with or without charge or donation, any dogs, cats, birds or other animals commonly kept as pets, or who sells or offers for sale or exchange any food, supplies or equipment for such animals or pets.
Sec. 10-2-8.2. – State license required.
It is unlawful for any person to engage in the business or activity of a pet shop operator within the city unless he or she shall be currently duly licensed as such under the provisions of the Animal Welfare Act where required.
Sec. 10-2-8.3. – Duties of pet shop operator.
Every pet shop operator shall:
(1) Maintain proper sanitary conditions and ensure proper ventilation;
(2) Provide adequate nutrition and humane care and treatment for all animals under his or her custody;
(3) Take reasonable care to release for sale, trade or adoption only those animals which are free from disease, injuries or abnormalities. A health certificate meeting the requirements of the state health department and issued by a licensed veterinarian for any such animal within five days before such sale, trade or adoption shall be prima facie evidence that the pet shop operator has taken reasonable care as required herein; and
(4) Comply with all applicable provisions of this Code regulating health, sanitation and safety.
Sec. 10-2-8.4. – Right of inspection.
The city health officer or authorized agent shall have power to inspect at any reasonable time the premises of any pet shop operator to determine compliance with this chapter or any applicable provision of state law.
