ARTICLE V. – KENNEL
Sec. 5-79. – Definition.
The term “animal kennel” is hereby defined to mean any establishment or premises wherein or whereon animals are kept for the purpose of breeding, boarding, sale, exchange or sporting.
Sec. 5-80. – Allowing animals off premises restricted.
No animal shall be permitted to stray or to be taken anywhere outside the limits of the kennel, unless such animal is on leash or is taken out temporarily for the purpose of hunting, breeding, trial, show or exhibition.
Sec. 5-81. – Maximum number of animals prescribed; maximum number of kennels prescribed.
No kennel shall contain more than 75 animals. The number of kennels shall be restricted to two.
Sec. 5-82. – Distance from property line for pens or connecting runways prescribed.
No kennel, including any pen or runway connected therewith, shall be located within 75 feet of the property line of the premises on which the kennel is located.
Sec. 5-83. – Maintenance of premises required.
All animal kennels shall be kept free and clean from decaying food, feces and from filth of any kind. The kennels, buildings, and pens shall be whitewashed or disinfected from time to time and shall be kept in a sanitary condition, satisfactory to the commissioner of buildings.
Sec. 5-84. – Burial of animals.
All animals buried on the premises on which any kennel is located shall be buried at least three feet below the surface of the ground and covered with not less than three feet of earth.
Sec. 5-85. – Inspection.
The commissioner of buildings and/or health commissioner shall periodically inspect each such place of buildings to determine whether the provisions of this article are being complied with.
Sec. 5-91. – Required; exemptions from animal registry fee.
No person shall engage in the business of operating an animal kennel without first having obtained a license therefor.
Any person licensed to operate a kennel shall be exempt from the payment of the animal registry fee for each and every animal which is kept in any licensed kennel.
Sec. 5-92. – Application; investigation of premises.
An application for the license shall be made in conformity with the general requirements of this Code relating to applications for licenses. Such application shall also state the number of dogs which it is proposed to keep in the establishment or premises for which application for license is made.
The commissioner of buildings shall cause an investigation to be made of the premises named and described in the application for the purpose of determining the fitness and suitability of said premises for such business from a sanitary standpoint.
Sec. 5-93. – Fees.
The annual license fee for each animal kennel shall be based on the number of animals which it is proposed to keep in the establishment or premises, and shall be as follows:
(1) Not to exceed 50 …..$50.00
(2) 51 to 75 …..75.00
In computing the number of animals, those under eight weeks of age shall not be counted.
Sec. 5-94. – Term.
All licenses issued for the business of operating a dog kennel shall expire on the thirtieth day of April following the date of issuance.
