Sec. 8-12. – Prohibiting the chaining of animals.

(a) Any person owning and/or controlling dogs or other domesticated pets whether vaccinated or unvaccinated, licensed or unlicensed, shall not allow said animal to be tied or chained to any object that prohibits the animal from roaming freely within 100 square feet of the object to which it is attached.

(b) No person shall, at any time, fasten; chain; or tie a domesticated animal or cause such animal to be fastened, chained or tied for a period to exceed 12 consecutive hours while such animal is on the owner’s property or on the property of the owners’ landlord, or on any property within the corporate limits of the City of Gardendale.

(c) Domesticated animals may be attached to an overhead run, such as a leash attached to an overhead wire at least ten feet long, that allows animals to move unheeded; or to a device attached to the ground that allows for the animal to freely move around said attachment for a full 360 degrees, for a period not to exceed 12 hours.

(d) Any domesticated animal confined within a fenced yard must have an adequate space for exercise based on a dimension of at least 100 square feet per animal.

(e) Nothing in this article shall be construed to prohibit owners or others for walking dogs or other domesticated animals with a hand held leash.

(f) Any violation of this article shall constitute a misdemeanor. Any person violating this article shall, upon conviction, be punished as provided in section 1-8 of the Code of Ordinances, City of Gardendale, Alabama. Each day shall constitute a separate offense.
