Sec. 5-9. – Impoundment.

(b) Redemption of impounded animals:

(4) If the owner comes to claim an animal after the five-day stray period, that owner may be required to adopt the animal, thus requiring the animal to be sterilized.

(5) An unaltered animal that is impounded as a stray three times shall be required to be altered at the pet owner’s expense prior to being returned to the owner. In the event that the animal is deemed by a licensed veterinarian to be too unhealthy to undergo surgery, that animal must be altered as soon as said animal is deemed healthy.

Sec. 5-17. – Prohibited acts.

(f) Breeding or sale of animals. It shall be unlawful for any person to breed or sell animals, or dispose of such animals for any commercial gain or other commercial purpose within the city.

Sec. 5-19. – Fees.

(a) The following schedule of civil penalties is hereby set and shall appear on citations issued by animal control/services officers, law enforcement officers, or code enforcement officers to any person who commits any infraction. (The amounts shown in parentheses indicate the sequence of fines to be imposed for uncontested first, second, third, and fourth offenses, respectively):

(15) Use of residence for commercial gain or breeding purposes ($103.00, $203.00, $303.00, $403.00).

In the event that such person contests the citation issued him or her, the fine will be set by the court in an amount not exceeding the statutory limits plus any costs the court may impose.
