§ 93.35 LICENSE.

(A) Any owner of a dog over the age of six months within the village shall, within 30 days after acquisition of the dog, acquire a license for the dog annually by or before the May 1 of each year. Licenses shall be issued by the Village Clerk upon payment of a license tax in the amount established by the Board of Trustees, plus the fee amount set forth in the village master fee list required under Neb. RS 54-603(3). It shall be unlawful for the owner of a dog to wrongfully and knowingly license an unspayed female dog as a male or spayed female dog if the Board has established different license taxes for such dogs.

§ 93.39 KENNEL.

(A) Definition of terms. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

KENNEL. The ownership, possession, keeping or harboring of more than two dogs, but not more than eight dogs, over the age of six months, for the purposes of breeding, feeding, buying or selling or raising of such animals, or any of the said purposes, or permitting more than two dogs, but not more than eight dogs, over the age of six months, to be or to remain upon his or her premises.

(B) Licensing required. Any person or persons maintaining a dog kennel, as defined above, shall be required to obtain a kennel license. A kennel license shall be issued after application is made to Village Clerk and after a hearing on said application is held before the Planning Commission and Village Board Of Trustees. At the time of said application for kennel license, the owner shall state, upon printed forms provided for such purpose, the owner’s name and address, the location of said kennel on the premises and the number of dogs to be kept in said kennel. Further, the kennel shall have a minimum of 48 square feet per adult dog and the applicant shall have written permission from the adjoining landowners and/or lessees waiving objections to said kennel.

(C) Kennel area defined. The area comprising any kennel proposed to be licensed shall be definite and certain, and the same shall be neither enlarged nor the location thereof changed, without first obtaining the consent of the Planning Commission and Village Board of Trustees. No licensee in the feeding of said dogs shall openly expose dead animal flesh, garbage, or refuse, or slaughter or kill any animal within said kennel for the purpose or permitting the dogs to feed upon the same; and, provided further, it shall be the duty of the licensee of any kennel to keep the same in a clean state and free from any matter creating offensive odors.

(D) Licensing fee and deadlines. A fee of the amount set forth in the village master fee list per year shall be charged for a kennel license. A person maintaining such kennel shall license the same by May l of each year. The license shall be delinquent from and after May 10.

(E) License revocation. A kennel license so issued may be revoked after a hearing before the Planning Commission and Village Board of Trustees if said kennel is not operating in accordance with applicable village laws and zoning requirements. No kennel shall be maintained in a manner which created offensive odors to neighbors. Upon receipt of a complaint, the Planning Commission shall set a hearing date to determine whether said license shall be recommended for revocation. Said recommendation shall go before the Village Board of Trustees who may revoke said license.

(F) Exceptions. It is specifically provided that any person or persons maintaining a kennel, as defined above, shall not have to comply with § 93.35 requiring the licensing of each dog in said kennel, but it is specifically provided that each dog in said kennel, over the age of six months, shall have a certificate or other substantial proof evidencing that each dog in said kennel is currently vaccinated for rabies, said certificate or other substantial proof to be available for inspection to officers of the Village Police Department or members of the Village Board of Trustees upon request.

(G) Prohibition. No owner shall be permitted to own, possess, keep or harbor more than eight dogs over the age of six months for any purpose within the corporate limits of the village, and/or within the zoning jurisdiction of the village.

(H) Severability. Should any section, paragraph, sentence or word of this section hereby adopted be declared for any reason to be invalid, it is the intent to the Chairperson and Board of Trustees of the village that it would have passed all other portions of this section independent of the elimination herefrom of any such portion as may be declared invalid.
