6.08.030 – Owner redemption of impounded animals.

B. In addition to paying the fees and charges specified in subsection A of this section, the owner of any nonspayed or unneutered dog or cat that is impounded shall be fined thirty-five dollars on the first occurrence, fifty dollars on the second occurrence and one hundred dollars on the third or subsequent occurrence in accordance with Sections 30804.7 and 31751.7 of the California Food and Agricultural Code. Any fines collected pursuant to this subdivision shall be deposited to the spay/neuter trust fund.

6.08.040 – Adoption of impounded animals.

A. At the conclusion of the required holding period for owner redemption, the director may make any impounded animal available for adoption. The adopting party shall enter into an adoption agreement with the director. No cat or dog over the age of three months shall be turned over to the adopting party without first being spayed or neutered unless a licensed veterinarian certifies that an animal is too sick or injured to be spayed or neutered or that it would otherwise be detrimental to the health of the cat or dog to be spayed or neutered. A spay/neuter deposit as established by resolution of the board shall be collected on all cats and dogs under the age of three months and those certified as too sick or injured at the time of adoption to be spayed or neutered. All spay/neuter fees and deposits shall be deposited to the spay/neuter trust fund, a non-interest bearing account. In the event a nursing female cat and her kittens or a nursing female dog and her puppies are adopted to one individual, only a single spay/neuter deposit shall be required. Except as otherwise provided, when a non-profit animal rescue or adoption organization enters into an agreement with the director for the release and adoption of sheltered animals, the requirement for spaying or neutering or posting of spay/neuter deposits prior to the release of such animals shall be waived pursuant to the terms and conditions of said agreement.
