5-2A-7: IMPOUNDMENT AND REDEMPTION PROVISIONS:

C.   Redemption Provisions: In order to redeem any dog or cat impounded under the provisions of this article, the owner or the custodian of such dog or cat must appear within seventy-two (72) hours and do the following:

2.   Furnish satisfactory evidence of vaccination and spay or neuter or produce a prepaid receipt for vaccination and spay and neuter by a licensed veterinarian;

E.    Any nonprofit organization may adopt an animal without a prepaid receipt for sterilization from a licensed veterinarian for thirty (30) days. After thirty (30) days the organization will need to produce proof the animal was spayed or neutered, or transported out of Eddy County, New Mexico.

F.    Upon adoption of any animal by a resident residing within Eddy County, the resident shall first secure sterilization of the animal. The expense of sterilization shall be borne by the adopting party. In the event that any individual residing outside of Eddy County desires to either rescue, adopt, or otherwise take possession of an animal from a shelter, then said party shall, at its sole expense, first obtain sterilization of the animal prior to that party taking possession of the animal.

G.    No person shall adopt an animal, or knowingly allow an animal to be adopted for the purpose of research, experimentation, breeding or fighting.

J.    Every dog or cat adopted from the animal shelter shall be altered by a licensed veterinarian at the sole expense of the adopting party. The adopting party shall produce a prepaid receipt with date of sterilization and vaccination imprinted on it, at time of pickup of the animal. Any additional fees assessed by the veterinarian in connection with preparing the animal for adoption shall be paid by the adopting party.
