§ 133-34 Definitions.

For purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:

KENNEL

Any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.

§ 133-35 License required.

Any person who keeps or operates or proposes to establish a kennel, a pet shop, a shelter or a pound shall apply to the Borough Clerk for a license entitling him to keep or operate such establishment.

§ 133-36 Application for license.

The application shall describe the premises where the establishment is located or is proposed to be located and the purpose for which it is to be maintained. It shall be accompanied by the written approval of the Board of Health showing compliance with the local and state rules and regulations governing the location of and sanitation at such establishments.

§ 133-37 Contents of license; transferability; revocation.

A. All licenses issued for a kennel, pet shop, shelter or pound shall state the purpose for which the establishment is maintained. All such licenses shall expire on the last day of January of the following year.

B. Any person holding such license shall not be required to secure individual licenses for dogs or cats owned by the licensee and kept at such establishment. The license shall not be transferable to another owner or for different premises. Such license may be revoked by the Mayor and Council on recommendation of the State Department of Health or of the Board of Health for failure to comply with the rules and regulations of the State Department of Health or of the Board of Health governing the same, provided that the licensee has been afforded a hearing by the State Department of Health or by the Board of Health.

§ 133-39 Dogs and cats to be under safe control when off-premises.

No dog or cat kept in a kennel, pet shop, shelter or pound shall be permitted off such premises, except on a leash or in a crate or other safe control.

§ 333-8 Enumeration of businesses requiring permit and annual fees.

The particular commercial services or enterprises for which a permit must be obtained and displayed are enumerated, but not limited to, as follows:

A. Animals:

(1) Hospitals, permit fee: $55.

(2) Kennels:

(a) For 10 or fewer dogs, license fee: $10.

(b) For more than 10 dogs, license fee: $25.
