6.04.010 – Definitions.

The following words and terms have the meanings herein indicated for the purposes of this chapter:

“Kennel” means any establishment wherein or whereon the business of boarding or selling dogs or breeding dogs for sale is carried on, except a pet shop.

6.04.020 License—When required.

Licenses are required for the following dogs of licensing age:

A. Any dog owned or kept within the city by a resident of the city on the first day of January of any calendar year;

B. Any dog acquired by any person during the course of any calendar year and kept within the city for more than ten (10) days after acquisition;

C. Any dog attaining licensing age during the course of the calendar year;

D. Any unlicensed dog brought into the city by any person and kept within the city for more than ten (10) days;

E. Any dog licensed by another state brought into the city by any person and kept within the city for more than ninety (90) days.

6.04.060 Fees.

Any person applying for a license is required to pay a fee in accordance with the following schedule:

6.04.090 – Pet shops, kennels, shelters, pounds—License required.

Any person who keeps or operates, or proposes to establish a kennel, pet shop, shelter or pound, shall apply to the city clerk for a license entitling him or her to keep or operate such establishment. Any person holding such license is not required to secure individual licenses for dogs owned by such licensee and kept at such establishments; such licenses are not transferable to another owner or different premises.

6.04.100 – Application information.

The application contains the following information:

A. The name and permanent and local address of the applicant;

B. The street address where the establishment is located, or proposed to be located, together with a general description of the premises;

C. The purposes for which it is to be maintained;

D. The maximum number of dogs to be accommodated by such establishment at any one time.

6.04.110 Approval of health officer.

No license is issued until the proposed licensee submits a written statement from the health officer that the establishment or proposed establishment complies with local and state rules governing the location of and sanitation at such establishment.

6.04.120 – License term.

All licenses issued for a kennel, pet shop, shelter or pound state the purpose for which the establishment is maintained and all such licenses expire on the last day of June of each year.

6.04.130– License fees.

The annual license fees for kennel and pet shop licenses are as follows:

6.04.140 – Compliance with state regulations.

A. All licenses issued for a kennel, pet shop, shelter or pound are subject to revocation by the governing body on recommendation of the state department of health or the health officer for failure to comply with the rules and regulations of the state department of health or the board of health, after the owner has been afforded a hearing by either the state department of health or the board of health.

B. Any person holding a license to establish, keep or operate a kennel, pet shop, shelter or pound shall comply with all city ordinances and the rules and regulations promulgated by the state department of health governing the sanitary conduct and operation of kennels, pet shops, shelters and pounds, the preservation of sanitation therein, and the prevention of the spread of rabies and other diseases of dogs within and from such establishments.

6.04.150 – Reports to state health department.

The clerk shall forward to the state department of health a list of all kennels, pet shops, shelters and pounds licensed within thirty (30) days after the licenses therefor are issued, which list includes the name and address of the licensee and the kind of license issued.

6.04.160 – Control of dogs off premises.

No dog kept in a kennel, pet shop, shelter or pound is permitted off such premises, except on leash or in a crate or other safe control.

6.08.050 Licensing requirements.

A. Cats Must Have License Number Displayed. Any person who owns, keeps or harbors a cat of licensing age shall annually apply for and procure from the city clerk a license and official registration tag with license number for each cat owned, kept or harbored, and place upon such cat a collar, or other device with the license number securely fastened or displayed. Acceptable methods of displaying license number include, but are not limited to, break-away or elastic collars. License tags are not transferable.

G. License Fee Schedule. A license is issued after payment of a fee of eighteen dollars and twenty cents ($18.20) for each un-neutered cat, and fifteen dollars and twenty cents ($15.20) for each neutered cat.
