Sec. 4-1. – Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Kennel means any premises wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs or cats, or any operation in which more than five (5) dogs or more than five (5) cats over the age of four (4) months are harbored at any residential unit.

Sec. 4-6. – Dog or kennel license.

(a) Any person owning, keeping, harboring, or having custody of any dog over four (4) months of age within this city must obtain a license for same. Any person operating a kennel within the city shall not be required to procure a license for each dog kept, such person shall obtain a kennel license upon application and payment of the required fees.

(c) The appropriate fee listed below shall be paid to the city for a dog or kennel license:

(1) For dog license, five dollars ($5.00) for a non-spayed female or non-neutered male. There will be no license fee for a spayed female or a neutered male. It shall be the responsibility of the owner of any spayed female or a neutered male to keep and provide upon request, proof that said dog has been spayed or neutered. There will also be no license fee for dogs owned by persons sixty-five (65) years of age or older.

(2) For a kennel license if not more than six (6) dogs are kept in the kennel, three dollars and seventy-five cents ($3.75).

(3) For kennel license, if seven (7) or more dogs are kept in the kennel, seven dollars and fifty cents ($7.50).

Sec. 4-7. – Dogs running at large.

(b) Any person found guilty of violating this section shall be subject to a penalty of fifty dollars ($50.00) for first offense, one hundred dollars ($100.00) for second offense within a twelve-month period, two hundred dollars ($200.00) for the third or subsequent offense within a twelve-month period. However, if said dog has been spayed or neutered and the owner of said dog provides proof that said animal has been spayed or neutered the fines levied above shall be reduced to the sum of twenty-five dollars ($25.00) for first offense, fifty dollars ($50.00) for second offense within a twelve-month period, and one hundred dollars ($100.00) for third or subsequent offense within a twelve-month period.

Sec. 4-21. – Cat license.

Any person residing in the city and owning or having in his or her possession any cats shall obtain a license as required by this chapter of the Carthage Code. There shall be a charge of five dollars ($5.00) for a non-spayed female or non-neutered male. Licenses for the keeping of cats shall expire annually on the anniversary date of its issuance. There will be no license fee for a spayed female or a neutered male. It shall be the responsibility of the owner of any spayed female or a neutered male to keep and provide upon request, proof that said cat has been spayed or neutered. Further, each cat must be vaccinated for rabies as provided in this chapter. There will also be no license fee for cats owned by persons sixty-five (65) years of age or older.

Sec. 4-23. – Kennels.

No person shall operate or maintain a dog kennel located within any area zoned district A, B, C-1, or C within the city.
