Sec. 10-101. – Required.

(a) No person or household shall own or harbor more than three dogs of six months of age or older or more than one litter of pups, or more than three cats of more than six months of age or more than one litter of kittens, or more than a total of three dogs and cats more than six months of age in any combination, or engage in the commercial business of breeding, buying, selling, trading, training, or boarding cats or dogs or both cats and dogs, without having obtained a permit from the city clerk.

Sec. 10-102. – Application.

Anyone desiring a permit to keep animals must make application in writing and provide all the following information:

(1) The name and address of the applicant.

(2) The address and legal description of the property upon which the animals are to be kept.

(3) A plot plan, drawn to scale, of the applicant’s property and all adjacent property within 100 feet, complete with all structures (existing and proposed), and indicating the area to be enclosed for the animals.

(4) Any other information bearing upon the maintenance, control or keeping of the animals as the city manager or his designee may require.

Sec. 10-104. – Issuance.

The city manager shall have the authority, after notification of adjacent and abutting property owners and a public hearing, to issue a permit for the keeping of animals pursuant to this article upon findings that:

(1) The application meets the requirements of section 10-102.

(2) All such animals will be provided suitable shelter.

(3) None of such animals will be permitted to run at large.

(4) Such shelter and enclosure will be maintained in a clean and sanitary condition free from offensive odors.

(5) Any fence used for the purpose of confining such animals on the premises shall be of a character to eliminate nuisance or damage to adjoining property.

(6) The keeping of the animals will not otherwise be detrimental to the neighborhood where such animals are proposed to be kept, or inimical to the public health, safety and welfare of persons residing in the neighborhood.

Sec. 10-106. – Grounds for revocation or denial.

The city manager or his designee shall revoke or deny any permit issued or required under this article if he finds that any of the animals enumerated in this article are permitted to, or do and will, run at large; or that the minimum distances specified for the permit are not or will not be observed; or that any house, runway, enclosure or other structure for the keeping of such animal is not or will not be maintained in a clean and sanitary condition or is not kept free of offensive odors at all times; or that the keeping of such animals has or will otherwise become detrimental to the surrounding property or persons residing or working therein. The revocation or denial shall be in writing, dated and sent to the address indicated in the permit or application.

Sec. 10-107. – Appeal of revocation or denial.

Any person whose permit issued or required under this article has been revoked or denied shall have the right of appeal to the governing body of the city. The appeal, in writing, shall be filed with the city clerk not later than 15 days after the date of denial or revocation. The city clerk shall set a date for hearing of the appeal, notice of which shall be given to the applicant not less than five days before the date set therefor, and the governing body shall render its decision on the appeal within 60 days of the filing of the appeal. Any revocation shall be held in abeyance pending final decision on appeal.

Sec. 10-153. – Conditions for adoption of dogs.

Any person shall be entitled to adopt a dog from the city pound if the following conditions and requirements are met:

(5) The dog, whether male or female, has been surgically spayed or neutered by a licensed veterinarian.

Sec. 10-167. – Conditions for adoptions of cats.

Any person shall be entitled to adopt a cat from the city pound if the following conditions and requirements are met:

(5) The cat, whether male or female, has been surgically spayed or neutered by a licensed veterinarian.
