Sec. 14-50. – Adoption.
(a) Any dog or cat, when offered for adoption, will not be released unless the animal has been surgically rendered incapable of reproduction by spaying or neutering, or the person wishing to adopt any dog or cat prior to the surgical procedures having been performed shall have executed a written agreement promising to have such service performed by a licensed veterinarian within a specified period of time. Failure to fulfill the terms of the agreement shall result in seizure and impoundment of the animal by the poundmaster, and any monies which have been deposited shall be forfeited.

(c) A fee or deposit shall be set and imposed by the pound for the adoption of any dog or cat that has not been rendered incapable of reproduction at the time of release. The deposit shall be refunded upon proof of fulfillment of the terms of the agreement to have the surgical procedure of spaying or neutering performed by a licensed veterinarian within a specific period of time.
