Sec. 10-1. – Definitions.
Kennel.
(1) The term “kennel” means any establishment wherein any person engages in the business of boarding, breeding, buying, grooming, letting for hire, training for a fee or selling dogs; provided, however, that the ownership of dogs which are a part of the household shall not constitute the operation of a kennel. The term “kennel” includes any premises at which more than two dogs or two cats are kept, even if not operated for business purposes.
Sec. 10-41. – Licensing.
(a) Required; application. No person shall own or keep a dog or cat of age four months or older within the village without first having obtained a license for such dog or cat. A grace period of 30 days shall be granted to owners or keepers of dogs or cats newly brought into the village. Application for such license shall be made to the village clerk, stating the owner’s name, address and telephone number, and stating the animal’s breed, sex, color and name, together with a veterinarian’s certificate that the dog or cat has been vaccinated against rabies within the preceding 12-month period. In no case shall the village clerk issue a dog or cat license except upon the applicant’s presentation of a current valid certificate from the county evidencing rabies inoculation.
(b) Fees. The license fee for a dog or cat that has been neutered or spayed shall be $10.00, to be paid to the village clerk prior to the issuance of a license. The license fee for a dog or cat that has not been neutered or spayed shall be $25.00, to be paid to the village clerk prior to the issuance of a license. A senior citizen may obtain one dog or one cat license per year for a reduced fee of $5.00, if the dog or cat is neutered or spayed.
ARTICLE IV. – KENNELS
Sec. 10-91. – Applicability; when licenses prohibited.
(a) The provisions of this article in respect to kennel licenses shall apply to the premises to which a license is issued.
(b) The requirements of this article shall apply to cats as well as dogs.
(c) Effective upon passage of this ordinance, kennel licenses in single family zoning districts are prohibited.
(d) Effective May 1, 1985, kennel licenses in multifamily zoning districts are prohibited.
Sec. 10-92. – Business license fee.
If operated as a business, a kennel operator shall pay an annual license fee of $45.00 and shall file with the village clerk a sworn statement or application containing therein the name and address of the applicant and the place at which the kennel is to be operated.
Sec. 10-93. – Restriction on location of business kennel.
A kennel operated as a business shall be operated only in premises zoned for business purposes.
Sec. 10-94. – Penalty.
Violations of any provision of this chapter shall be punishable by a fine not to exceed $750.00 per offense.
